Emotional distress, also known as pain and suffering, is calculated in personal injury cases taking into account factors such as the severity, duration, and impact of emotional distress on the victim's life. Courts also evaluate the evidence presented, including medical records, expert testimony, and witness accounts. There is no specific formula and the amount awarded can vary greatly depending on individual circumstances. The distress tolerance scale (formerly called the Distress Tolerance Questionnaire, DTQ) is a 15-point self-assessment measure of tolerance for emotional distress.
